Winback IQ — Terms of Service

These Terms govern your use of the Winback IQ Shopify app ("the App"). By

installing or using the App you agree to them. If you do not agree, uninstall the

App.

1. The service

Winback IQ reads your Shopify order history to compute an RFM (Recency /

Frequency / Monetary) segmentation of your customers, presents a revenue-ranked

win-back worklist and lifecycle insights, and — on the Pro plan — writes a

WinbackIQ:<Segment> tag back to your Shopify customers and lets you export the

worklist as CSV. The App is provided on a software-as-a-service basis and is

updated from time to time.

2. Honest-analysis disclaimer (important)

The segments and the "revenue at risk" figure are a **transparent classification

of your own past orders**, not a prediction of future behaviour. "Revenue at

risk" is the literal sum of the relevant customers' past spend — what is on the

line — not a forecast that those customers will or will not return. You are

responsible for the marketing and commercial decisions you make using the App's

output. We make no guarantee of any revenue recovered, retention rate, or

campaign result.

3. Plans, billing & trials

Insights tab and the playbook, at no charge.

on your Shopify invoice. On development stores, charges are test charges

(no real money is taken). You can change or cancel your plan at any time from

the Plan tab or your Shopify admin; access to paid features ends when the

subscription is cancelled, expires, or is frozen.

4. Acceptable use

You agree not to: reverse-engineer or resell the App; use it to violate any law

or any third party's privacy or rights; or use it to process data you are not

authorised to process. You must have the right to process your customers' order

data for retention/marketing analysis under applicable law and your own privacy

policy.

5. Your data & customer data

You retain ownership of your store data. We process it only to provide the App,

as described in the Privacy Policy, which is incorporated into these Terms.

We store only an opaque customer ID plus numeric aggregates — never customer PII.

You are the data controller for your customers' data; we are your processor.

6. Availability

We aim for high availability but do not guarantee uninterrupted or error-free

operation. We may perform maintenance, and we may modify or discontinue features.

7. Warranty disclaimer

The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind,

express or implied, including merchantability, fitness for a particular purpose,

and non-infringement, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect,

incidental, special, consequential or punitive damages, or for lost profits,

revenue, data or goodwill. Our total aggregate liability arising out of or

relating to the App is limited to the amounts you paid for the App in the three

(3) months preceding the event giving rise to the claim.

9. Termination

You may stop using the App at any time by uninstalling it. We may suspend or

terminate access for breach of these Terms. On uninstall, data is deleted per the

Privacy Policy's retention section.

10. Changes to these Terms

We may update these Terms; material changes will be reflected by the "Last

updated" date. Continued use after a change constitutes acceptance.
